Visit to the Delyatinskogo psycho-neurological institution

March 29, 2023, 15:15 97 ombudsman.gov.ua Employees of the Department for Implementation of the National Preventive Mechanism visited the place of incarceration - the Delyatinskogo psycho-neurological institution of the Ivano-Frankivsk regional.

The institution is a stationary residential institution of social protection, which is formed for the temporary or permanent residence/stay of citizens (women) with persistent intellectual and/or mental disorders who, due to their health, require external care, social and household services, the provision of medical assistance, social services and a complex of rehabilitation measures and for whom, according to the conclusion of the medical commission with the participation of a psychiatrist, a stay in a psycho-neurological institution is not contraindicated. At the time of the visit, there were 168 women in the psycho-neurological institution.

As a result of the visit the NPM, numerous shortcomings in the work of the psycho-neurological institution were revealed, which lead to the violation of the rights of the wards. In particular, it was established that the wards do not provide written informed consent for treatment, the institution does not organize an examination of the wards by a medical and advisory board with the participation of a psychiatrist, hemolytic control is not ensured for the wards who are prescribed drugs with the active substance "clozapine" for a long time, which can lead to to severe consequences for their health. The vast majority of wards need dental care, numerous violations of sanitary and hygienic norms, violations of the established standard of living space per ward were found.

The psycho-neurological institution does not follow the principles of barrier-free access, which makes it impossible for the wards to have independent access to the premises located on the first floor of the building, as well as access to fresh air. In the psycho-neurological institution, the wards do not have unimpeded access to drinking water - the wards draw water from the taps in the bathrooms. A violation of the wards' right to own, use and dispose of their own funds was established, as pensions of incapacitated wards are not spent on their needs, but are accumulated in bank accounts, due to the fact that the management of the institution does not want to take responsibility. At the time of the visit, the total amount of funds of 16 incapacitated wards, accumulated in bank accounts, is $ 28 977.

In addition, the psycho-neurological institution does not record cases of injuries to wards. The NPM team found women who had fresh injuries to the face and head, although the latest entry in the trauma log was dated August 2022. During communication, it was found out that some wards were injured as a result of a fall, however, there are frequent cases of violence among wards in relation to each other in the psycho-neurological institution. This indicates the concealment of the facts of receiving physical injuries by the wards and, as a result, may lead to a violation of their right to protection from torture and other cruel, inhuman or degrading treatment.

In order to eliminate the detected violations of the rights and freedoms of persons who are provided with social services for inpatient care, appropriate response acts will be directed to the competent authorities.
